1. About Centre of Local Government Studies (CLGS)

Lviv public organization ‘Center of local government studies’ is a non-profit, non-governmental public organization founded in 2007.

CLGS’s activities focus mainly on issues of municipal policy, municipal development and management. The Centre also closely deals with issues of residential property management, support of condominium institutional capacity building, and elaboration of strategies for housing economy reforms in Ukraine. 

 

Lviv public organization ‘Center of local government studies’ has a long and successful experience in projects and elaborations dealing with reforming the management and maintenance of residential property in Ukraine since its founding in 2007. During this time experts of the Centre conducted a thorough research of Housing Management of Eastern European countries, as well as held a series of training courses and  seminars in many cities of Ukraine on reforming the system of housing management and maintenance.

The Center has a group of specialists and experts in legal issues, accounting, maintenance of buildings, organization of self-government and professional management in the apartment building, land issues, the resolution of disputes with service providers and practicing heads of condominium associations for conducting trainings; the Center established partner network for training workshops in the Western Ukraine (Novovolynsk, Kamjanets, Chernivtsi, Ternopil, Ivano-Frankivsk, Dolyna, Kovel) and southern and central Ukraine (Mykolaiv, Poltava); developed information web-portals (www.cdms.org.ua, www.epi.lviv.ua) for these tasks. Experts of the Center already developed and implemented an automated accounting in condominium buildings in 8 cities of Ukraine.

The Center initiated amendments to the Housing Code of Ukraine in respect of housing management models and professional requirements and certification of residential real estate managers as part of the tender supported by International Renaissance Foundation “Public initiatives in reforming the housing”.

The most significant accomplishment of the organization demonstrating its potential to implement the project is the publication of two textbooks "Professional management of residential real estate" (272 p.) and "Practical aspects of residential real estate management" (220 p.), and curriculum for the training workshop (30 academic hours) for heads of house committees, condominiums’ managers and accountants. The electronic (online) version of textbooks and curriculum is uploaded on the portal of the Centre of local government studies www.cdms.org.ua  .

In 2008-2011 the Center on the basis of developed curriculum with the support of the IF "Renaissance", local authorities and F. Naumann Foundation held two-day trainings in the cities of Western Ukraine (Lutsk, Chernivtsi, Novovolynsk, Volodymyr-Volynsky, Ivano-Frankivsk, Kamjanets-Podilsky, Ternopil) and 4-day seminars in Lviv, Rivne, Dolyna.

The Center also provides textbooks and assistance to condominiums Resource centers in Lutsk, Voznesensk, Uzhgorod.

The Center is a co-founder of Lviv Resource center for condominiums and constantly supports the Resource Center with information materials, its own publications (practical guides, brochures), the experts of the Centre provide trainings and professional advice.

3. Activity

Activity of CLGS is focused on promotion of reforms in municipal economy of Ukraine, facilitation of dialog between local municipal authorities and the public (i.e., various target groups in projects realized by CLGS), elaboration of effective means of communication and strategies of cooperation between local authorities and the target groups.    

This goal is achieved through the organization of thematic round tables, conferences, seminars, conducting research and publication of the results. Representatives of the Centre take part in working groups and commissions on the preparation of legal acts for the local governments and central bodies of executive power.

Main directions of activity are:

  • Promotion of participation of local governments in international grant programs;
  • Analytical research with further preparation of conclusions and proposals on the elaboration of the regional development strategy;
  • Promotion of cooperation of the public (citizens) with business, municipal authority and civil society organizations.
  • Elaboration of the methodology in solving social, economic, legal, ecological problems of the local government.
  • Promotion of cooperation and exchange of experience between the local governments’ bodies, state authorities of the region and abroad.

3.1 Municipal government and development (information technologies, e-government, quality management ISO, Centers of administrative services)

The quality management system ISO 9001.

Implementation of the quality management system in public institutions such as city councils, facilitates the activity of the council and leads to its improvement through the regulation of the city council officials’ duties in accordance with requirements of ISO 9001, the establishment of interaction with the community through improved service quality, enhancement of the image of the city council for citizens and investors and is the basis for obtaining the ISO certificate of quality.

Creating Centers of administrative services.

Centers of administrative services provision (CASP) today is one of the best organizational forms of service provision and interaction between the authorities and the community. CASP implements the principle of obtaining any information, advice or services in one place, with appropriate conditions, qualified and friendly staff to the citizens. CASP is the main place of effective communication between the city community and city authorities.

3.2 Residential property management

Refroms in the sector of municipal economy, mainly in housing sector, and its improvement in Ukraine is one of the key issues of CLGS activities. Municipal economy of each country belongs to the priority areas of domestic policy and is one of the most important sectors of the economy and social policy that ensures social stability in the country and development of civil society. The Soviet model of housing, based on the principles of command planned economy is no longer effective in a democratic society and market economy. Moreover, preservation and application of old principles and methods of housing maintenance and management in the country's new conditions leads to rapid deterioration of the housing stock of the country, worsening the quality of utility services and is the cause of social tension. It happens because the above-mentioned reasons and because of continued growth of prices for communal utility  services, non-transparent calculation of tariffs and charges for the consumed services. Efforts to reform housing in Ukraine continues for the last 20 years, but without any positive significant results of these reforms. Along with the steady deterioration in the housing area of the country and low quality of communal utility services, there is a permanent reduction of qualifications of the personnel working in housing maintenance and management sector who turned to be unprepared to work in the market condition, and ultimately have no incentive to improve their skills. Working in housing sector is considered a non-prestigious and poorly paid, particularly at the level of ordinary workers.

Attempts to solve the problem of lack of qualification in housing (residential) sector, as well as change the very principles and methods of work in that sector which meet the needs and challenges of our time, last for a long time. A number of regulations were adopted to set the foundation for the development of new advanced training programs for management personnel in utilities. This is declared, i.a., in Appendix #1 to the National Program of Reforming and Development of Housing for 2009 – 2014.

One of the main factors hindering the process of reforms is the lack of necessary legislation, outdated legislation in specific areas of housing sector, and not effective provisions of legislation in other areas of housing economy. For example, provisions on responsibility for maintenance of common property by the owners of the apartment buildings are unclear and ambiguous; provisions and practical measures to reform existing communal enterprises (Zhek) are absent in legislation at all, as well as measures called to create a market of high quality utilities and introduce a profession of the manager of residential real estate. And unsound public policy and inconsistent, imperfect legislation causes that newly established condominiums (OSBB), which want to manage their common residential property find themselves in even worse situation than before their establishment, thus giving no stimuli for people (owners of residential property, apartments) to create new condominiums.

Lack of professional management and market service providers, poor assistance and support for condominiums at the local and state level have put the entire housing sector at risk.

 

An important component of reforms in the housing sector is the involvement of the public to the development of housing policy and reforms of housing and communal utility services.It includes training of officials of local governments, utilities workers and heads of condominiums on the reforms and development of housing, developing and implementing educational programs and support educational reform in the housing and utilities, development and implementation of local programs involving the public in the formation of housing policy and the reform of housing.
CLGS has realized (5) projects since 2007 which concern the problem of reforming the management of housing sector, and introduce effective instruments and principles of managing the residential buildings. These projects mainly focused on strengthening condominiums institutional capacities and elaborating strategies of residential housing management. 

 

3.3 Energy efficiency in residential sector

Energy efficiency in conditions of global economy and ever-growing energy consumption in industry is the main priority in domestic policy of the state. Reasons for saving energy and reducing energy consumption also include permanent increase of rates for energy both for population and industry, and environmental reasons, that is, consequent rejection from traditional energy sources and switching to renewable sources.

However, we must admit that in Ukraine energy efficiency measures are only outlined on paper, but almost nothing is being done in this field in the country. There is no way to avoid these problems but delaying their resolution only worsens the situation.

The main way to significantly reduce energy consumption and particularly natural gas consumption which is the main source of heating buildings in the residential sector is thermal modernization (insulation) of buildings. Measures to make buildings more energy efficient can be done in almost all categories of buildings but especially effective and tangible results can be achieved in large buildings (apartment buildings, hospitals, schools, etc.). Moreover, the older is building and the worse materials used in its construction - the better will be the results of insulation. 

One of the main reasons of slow introduction of energy saving measures in the residential sector of Ukraine is very ineffective legislation.

To be brief describing the core of this legislation, we should say that government policy and regulation of building insulation and other energy saving measures in Ukraine are envisaged only for certain industries, but not for residential sector  (households). Instead, there is unclear and not always fair distribution of large amounts of budget funds among individual economic agents, especially industrial and commercial enterprises and budgetary institutions, the activities and practices of which: 1) do not cause large savings on a national scale, 2) does not create a model for successful distribution of samples in other areas, particularly in housing.

Thus, it is evident that Ukraine urgently needs to change existing laws and schemes for energy saving measures, making them truly effective and realistic to implement. 

CLGS in partnership with Polish, German and Ukrainian partners held a number of events (seminars, round tables), and took part in projects on promoting building insulation and other energy saving measures in residential sector of Ukraine. The potential and capacities of the Centre in this sphere are enough to implement projects and be partners in projects, contributing to improvement of living conditions of the Ukrainians.

 

3.4 Public legal disputes resolution

Taking into account the peculiarities of the Ukraine’s judiciary, administrative courts can not consider such big amount of cases.  It is practically impossible to resolve a dispute quickly and stay on good terms. It causes absence of citizens’ faith that courts can effectively protect their rights and legitimate interests. 

That’s why the applying of non-judicial means of resolving public law disputes is extremely important. It is about two groups of means. First group, traditional for our country, involves representatives of the state: the appeal to higher authorities of public administration and appeal to the prosecutor. Second group is usually called alternative dispute resolution means that are widely applied in developed countries. Alternative ways (such as negotiation, "shuttle" diplomacy, mediation) can not only resolve the dispute, but also regulate it in the way where each side feels the consideration of his\her  interests in the final decision making process. 

Special attention is paid to mediation, an alternate to judicial and much more efficient method of solving disputes by enlisting the services of a mediator who helps parties resolve conflicts. Using mediation, parties can save both time & money, necessary for the case to be tried by the court, and friendly business or family relations. Besides, there are no winners of losers at mediation.

4. Ongoing projects (2011-2012):

1. “Public initiatives in reforming housing economy of Ukraine” implemented by Kyiv association of house owners and Lviv public organization “Center of local government studies” (project head manager - Volodymyr Brygilevych) envisage initiating amendments to the Housing Code of Ukraine, laws on condominiums (OSBE)and other regulations concerning the activity of condominiums (OSBE in Ukraine and measures to facilitate their activity.

2. “Organization of the activities for the establishment of the Centre of administrative services provision in Khmelnytsky” implemented by CLGS (project head manager – Ihor Brygilevych).

3. “Completing of the educational program “Residential real estate manager” and a pilot implementation in cities of the Western Ukraine” implemented by CLGS (project head manager - Volodymyr Brygilevych).

 

5. Experience in implementing projects.

During 2007 – 2010 the Centre of local government studies with the support of the International Renaissance Foundation successfully introduced the following projects:

  • ‘Regulation of the relations between Lviv citizens and local authorities” aimed at the improvement of forms of participation of the city public in the decision making process in municipal matters and their regulation.
  • “Study of the experience of cooperation of the city public (citizens) and local authorities of Krakow in the process of forming the communal tariffs and its dissemination in Ukraine” aimed at advancement of qualitative models of cooperation between the city public and local authorities of Ukraine’s cites in questions of forming communal tariffs.”
  • “Improvement of the mechanisms of administrative justice, of information access of the public about the possibilities to solve public arguments”. 
  • “Elaboration of the training-study course for the heads of apartment houses associations and communal enterprises on the basis the Polish experience in reforming the housing and utilities economy”.
  • “Establishment of the regional informational and study centre on the housing property management”. (2009);- “Support of activities of the regional information and study centre on housing property management” (2010).
  • Public initiatives in reforming the housing economy of Ukraine. (2011).

With the support of Friedrich Nauman international foundation during 2007 – 2009 the Centre carried out the following projects:

  • Two-day seminar for the representatives of the local governments of Volyn, Lviv and Ternopil regions “Aspects of strategic planning of the city development”. (Навчальні семінари «Впровадження ринкових механізмів в управління житловою нерухомістю »  у м. Тернопіль (травень 2009 р.) та смт. Брюховичі (вересень 2009 р. за підтримки Фонду Наумана.).
  • Round table “Lviv in the next decade”, participating representatives of the deputies of Ukraine’s parliament and Local authorities officials, businessmen, scholars and public figures. (круглий стіл на тему «Львів у найближчому десятилітті» за участі представників депутатського корпусу та службовців міської ради, підприємців, громадських діячів, науковців).
  • Round table “Does Ukraine need a megalopolis Vinnytsia?” - Two-day seminar “State authorities, public and mass media: effective cooperation – the interest of the city”.- Study seminars “Introduction of market mechanisms in residential property management” in Ternopil (May 2009) and Brukhovychi (Lviv region, September 2009).

With the support of the Polish Embassy grant program during the 2011 the CLGS participated in: 

  • In the frames of the project “Introduction of the European standards in management of energy and water supply in residential stock on the basis of Polish best practices” which was implemented in 2011 by Krakow association of real estate managers and Lviv public organization “Information consulting centre”, a textbook “Management of the energy consumption in residential property” on energy saving issues was published in which CLGS experts were co-authors.
